The court also said that if the police wanted to record Kamra's statement, they shall do so in Chennai, where he currently resides, after giving him prior notice.
The panel noted that it may be argued that criminal prosecution for defamatory statements is opposed to the right to freedom of speech and expression.
Under the relevant law, the activist may get a jail term of two years or fine or both as the punishment.
