The Delhi High Court has reserved its order on a plea by jailed MP Rashid Engineer, facing trial in a terror funding case, seeking custody parole to attend the ongoing Parliament session. The court said though there might not be a vested right to attend the session, it could exercise its discretion. During the trial, the CBI produced 61 witnesses in support of its case, while 27 witnesses were produced by the accused in their defence. Sarkar, a legislator from Purnea, was shot dead by men acting on Yadav's orders on June 14, 1998.
A bench headed by Justice S B Sinha, however, allowed the RJD leader to approach the court in future for other relief on the ground of his bad health. The bench also said that all efforts will be made to conduct the trial through video conferencing for the MP, who is facing problems in movement due to morbid obesity.
"Under the fact and circumstances of the case, we do not find merit in his appeal," a Bench comprising Justice S B Sinha and Justice Markandeya Katju said dismissing the bail petition challenging the Patna high court order.
