The Supreme Court Thursday dismissed a plea filed by Facebook India Vice President and MD Ajit Mohan challenging the summons issued by the Delhi Assembly's Peace and Harmony committee for failing to appear before it as witness in connection with the north-east Delhi riots last year.
A Delhi assembly committee asked Facebook India on Thursday to furnish records of users' reports (complaints) on the content posted on the platform one month prior and two months after the northeast Delhi riots in February 2020.
The panel had issued a notice to Facebook India vice president and managing director Ajit Mohan last week, asking him to appear before it on September 15 in connection with complaints about the social media giant's alleged deliberate inaction to curb hateful content in the country.
'The reality is no one, including some of the names that have shown up in the last few weeks, have any unilateral decision-making power in this,' Facebook India MD Ajit Mohan tells Peerzada Abrar.
'Under Section 79 of the IT Act, Facebook is mandated to exercise care. Once you have a duty, you do not have the right to silence; you need to show compliance.'
Following the order, the Peace and Harmony Committee of the Delhi Assembly deferred its proceedings, and said it would notify the further course of action and the next date of sitting in due course of time.
