Trump nominated Thapar for the 6th US Circuit Court of Appeals.
Thapar currently holds the position of US District Court Judge for the Eastern District of Kentucky.
This would be for the second time that Thapar, son of Indian-American immigrants, might not be able to make the final cut after being interviewed by the US president.
Amul Thapar, 47, had become in 2007 the first South Asian Article III judge when he was appointed as a US District Judge for the Eastern District of Kentucky.
Trump picked Justice Kavanaugh from his original list of 25 judges, which also included prominent Indian-American judge Amul Thapar, from which he had said he would nominate for any vacancy in the Supreme Court.
