The bench, also comprising justices Surya Kant and Hima Kohli, said that it will have to take the consent of the judge concerned and will consider names of even former apex court and high court judges for monitoring the probe in the sensational case and pronounce the same on Wednesday.
The Supreme Court on Monday suggested that a former high court judge monitor the ongoing probe by the Uttar Pradesh police into the October 3 Lakhimpur Kheri incident in which eight people, including four farmers, were killed in violence during a farmers' protest, saying the investigation was not going the way it expected.
An application has been filed by advocates Shiv Kumar Tripathi and CS Panda in the suo motu case registered on a letter petition sought setting aside of the order dated February 10 of the Lucknow bench of the Allahabad high court.
"Those named in the FIR should go to jail. The government should take immediate action and the matter should be probed by a sitting judge of the high court. There are videos clips, statements of eyewitnesses, the statement (of minister) in which he is threatening. As he (accused Ashish Mishra) is the son of the MoS, action has note been taken yet," he said.
The affidavit was filed in response to a petition seeking a direction to declare the PM CARES Fund a 'State' under the Constitution to ensure transparency in its functioning.

The PM CARES Fund is not a Government of India fund and the amount collected by it does not go to the Consolidated Fund of India, the Delhi High Court has been informed.
