The Supreme Court of India has refused to relax the ban on firecrackers in the Delhi-NCR region, citing continued alarming levels of air pollution. The court emphasized the right to a pollution-free atmosphere as a fundamental right, stating that the ban is necessary to protect public health. The court also highlighted the issue of noise pollution caused by firecrackers. The decision comes after a batch of petitions were filed by firecracker manufacturers seeking relaxation of the ban.
A bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia also suggested why should there be any purchase under the minimum support price system from farmers who indulge in crop residue burning, irrespective of the fact that citizens and children were affected due to pollution.
Amid a spike in pollution levels in Delhi-NCR, the Supreme Court on Tuesday directed Punjab, Haryana, Uttar Pradesh and Rajasthan to ensure crop residue burning was stopped "forthwith", saying it cannot let "people die" due to pollution.
A three-judge bench headed by Justice Madan B Lokur made it clear that only BS VI compliant vehicle shall be sold in the country from April 1, 2020.
A bench headed by Justice Arun Mishra said Bharat Stage-IV vehicles sold after March 31 this year and those whose details have not been uploaded on the e-Vahan portal of the government will not be registered.
With CPCB saying that the air quality is not severe now, the SC partially lifted its ban.
Congress termed the raids as highly vindictive and said it is part of "PM Narendra Modi's hate agenda and political vendetta against the Congress and its leaders".
The top court called the pollution in Delhi-NCR as atrocious and said no one is safe even inside homes. "It is too much. No one is safe even inside their house. It is atrocious," the bench said.
