A bench headed by Justice P Sathasivam asked the petitioner to approach the appropriate high court for remedy.
"Till the Supreme Court delivers its ruling in the case, I will not appear in the lower court where trial in the case filed by the state CID is going on and the investigation in the case is not yet complete."
In a new twist in the murder of Ujjain professor Y K Sabharwal, his son Himanshu's driver has been found murdered near Delhi University campus.
He is seeking a Central Bureau of Investigation enquiry into the incident.
