The Calcutta High Court overturned a single bench order that annulled the appointments of 32,000 primary school teachers in West Bengal, stating that irregularities were not proven in all recruitments. The decision brings relief to the teachers and is seen as a boost for the TMC-led state government.
The judgment will impact a sizeable number of people in the state, according to a lawyer involved in the matter.
In the letter to the BJP, the West Bengal government said, "The areas proposed to be covered by the yatra are, because of publicity and propaganda, gradually turning into communally sensitive pockets. Intelligence reports indicate that public perception is that the religious overtones of the yatra will be turned into communal propaganda."
The division bench said the order needs to consider afresh the 36 intelligence inputs submitted by the state government before the single bench.
Justice Chakraborty said that the petitioner BJP will be vicariously responsible for any damage or loss of public property.
The Bharatiya Janata Party decided to put on hold Shah's proposed rally and the Rath Yatra, saying it will wait for the final order from the high court, which will now hear an appeal by the saffron party on Friday morning.
A division bench of justices Biswanath Somadder and A Mukherjee said the government's silence on the permission is 'astonishing and astounding'.
