Court orders FIR on molestation plea against Kumar Vishwas

A Delhi court on Wednesday ordered lodging of a first information report on a plea by an Aam Aadmi Party volunteer alleging molestation by party leader Kumar Vishwas with a liberty to police to arrest him if required during the investigation.

The court also said the complaint accuses him of making ‘sexually coloured’ remarks which requires probe.

Metropolitan magistrate Pankaj Sharma, while pronouncing the order, also orally observed that as per the complaint, advances were made towards the complainant.

“The facts of the complaint disclosed commission of cognisable offence. As mentioned in the complaint, accused made sexually coloured remarks and made advances towards the complainant which require police investigation and accordingly concerned station house officer is directed to register an FIR on the basis of complaint and investigate the matter,” the magistrate said, while allowing the complaint filed by the woman.

The court further said that ‘the investigation shall be done uninfluenced and arrest be made when required’.

It also directed the police to file the compliance report by Thursday.

The court had on February 24 reserved its order on the complaint in which the complainant claimed she had approached the police but no action was taken against the leader.

In its status report filed before the court, Delhi police had said during its probe, nothing was found to substantiate the allegations levelled by the complainant against Vishwas to register any criminal case against him.

The court had on December 21, last year asked the police to file a status report as to whether any FIR has been registered on the complaint.

The woman, in her complaint seeking registration of FIR against Vishwas, alleged that he had molested her in New Delhi.
