The Karnataka high court on Tuesday struck down the appointment of Justice Chandrashekaraiah, the Upa Lokayukta. Justice N Kumar and Justice Kempanna observed that due process was not followed while appointing the Upa Lokayukta.
While Chief Justice Kehar Singh ruled that the Speaker was right in passing the order disqualifying the MLAs, Justice N Kumar held that the Speaker had not followed procedure 102A of the Constitution (which deals with disqualification).

A new single bench of the Karnataka high court on Wednesday adjourned the disqualification of 11 rebel Bharatiya Janata Party Members of Legislative Assembly who had challenged their disqualification from the state assembly. The case had come up before Justice V G Sabhahith after the court delivered a split verdict two days ago on the petitions. The two-judge bench had divergent views in respect to the order disqualifying the MLAs. While the chief justice upheld the order of the Speaker, Justice N Kumar found the Speaker's order to be wrong.
