Taking a very serious note of alleged defiance of court's orders by the Uttar Pradesh government, the Lucknow bench of Allahabad high court on Thursday even went to the extent of suggesting that there was breakdown of Constitutional machinery in the state.
In what was described as an unprecedented move, the Lucknow bench of the Allahabad high court on Thursday summoned Uttar Pradesh Chief Secretary Anoop Misra to make personal appearance in a public interest litigation alleging large scale grabbing of land earmarked and used as the Indian Army firing range in Lucknow.
The Lucknow bench of Allahabad High Court on Tuesday reserved its verdict on a plea for a Central Bureau of Investigation probe into the murder of jailed Lucknow deputy chief medical officer Dr Y S Sachan.
The bench, also comprising justices Surya Kant and Hima Kohli, said that it will have to take the consent of the judge concerned and will consider names of even former apex court and high court judges for monitoring the probe in the sensational case and pronounce the same on Wednesday.
The Supreme Court on Monday suggested that a former high court judge monitor the ongoing probe by the Uttar Pradesh police into the October 3 Lakhimpur Kheri incident in which eight people, including four farmers, were killed in violence during a farmers' protest, saying the investigation was not going the way it expected.
The Supreme Court of India on Wednesday appointed Justice Rakesh Kumar Jain, a former judge of the Punjab and Haryana high court, to supervise the Uttar Pradesh SIT's probe on day-to-day basis into the Lakhimpur Kheri violence in which eight people including four farmers were killed on October 3.
"Would your Lordships give me time till Monday? I have almost got it done. We are working something out," senior advocate Harish Salve, appearing for the UP government, told the bench headed by Chief Justice N V Ramana. "List on Monday," said the bench which, also comprised justices Surya Kant and Hima Kohli, acceding to the request.
The four accused were shot dead on NH-44 near Hyderabad -- the same highway-- where the charred body of a 27-year-old veterinarian was found.
Indian Police Service Officer R K Sharma, the prime suspect in the Shivani Bhatnagar murder case, has been found guilty by a Delhi court. Five others also have been found guilty for murdering the journalist.
