Telecom major Bharti Group Chairman and Managing Director Sunil Bharti Mittal denied any attempt on forming a cartel with other telecom players to distort competition. Bharti Airtel had received a 'notice of enquiry' by anti- monopoly watchdog MRTPC. Vodafone Essar and Idea Cellular too had received such notices. It was alleged that 3 GSM operators, by colluding, have simultaneously increased the price. Mittal said that MVNOs will not work in India due to existing tariffs.

India's anti-trust body CCI, which would ultimately replace MRTPC, is an independent body responsible for investigating mergers, market shares and conditions and the regulation of firms. Section 66 of the Competition Act deals with repealing and dissolution of the MRTPC Act, 1969. With the operationalisation of CCI, MRTPC was supposed to stop entertaining new cases and was to deal with pending cases for two years before being completely dissolved.

There would be a gap in legislation to be caused by proposed winding up of MRTPC with respect to unfair trade practices. The gap can be filled in be establishing NCPA through enactment of National Consumer Protection Authority Act, the document said. The MRTPC, which has been looking into various unfair trade practices would be wound up to make way for Competition Commission, which is likely to be fully operational by the end of next year.
