Additional Sessions Judge Talwant Singh, considering the fact that the accused Nirmala was having two motorbikes in her name out of which one was recovered from the spot of the offence, issued summons against her and asked her to appear before it on August 4, the next date of hearing.
The ASJ lent credence to the fact that the accused, a resident of Nand Nagari in northeast Delhi, was not having the valid driving license. The police, in their revision petition filed through Y P S Ahluwalia, challenged the acquittal order of Metropolitan Magistrate G N Pandey saying the fact that she was supplying motorcycles to criminal for pecuniary considerations was overlooked.
"In this way, she was abetting/ aiding the criminals involved in various heinous offences by using the said motorcycles provided by her to them," alleged police. As per the prosecution, one Sanjeev and his co-accused, riding a motorbike, on the evening of July 1, this year snatched a gold chain from one Shobhana who along with her husband was going to a nearby market in Khureji of east Delhi.
The duo, in their bid to flee from the spot, got fear stricken and collided with a car as the victim raised the alarm.
Later, they fled from the spot leaving behind the motorcycle and a mobile phone. During the probe, it was revealed that the vehicle belonged to Nirmala who, a day later, was acquitted by the Magistrate.
"I fail to find any ground for the arrest of the accused and the police have also failed to impute any conspiracy and participation of the accused in the offence," observed the trial court setting Nirmala Devi free.
