The Supreme Court on Monday refrained from granting bail to Vikas Yadav, son of former Rajya Sabha member DP Yadav and prime accused in the Nitish Katara murder case.

A bench comprising Chief Justices K G Balakrishnan and justices R V Raveendran and L S Panta, however, sought replies from the Delhi and UP police on the plea of the accused.

Senior counsel K T S Tulsi, appearing for the accused, sought bail to Vikas on the ground that the latter had lost about 10kg weight due to suspected Tuberculosis, which he reportedly contracted during his five-year stay in the jail.

He

submitted that Vikas should be released on humanitarian grounds as it would enable his family to provide him with proper medical facilities.

Tulsi, further argued that Vikas, who is in jail for the past five years was entitled to bail as his cousin and co-accused Vishal Yadav has already been granted bail by the Delhi High Court.

However, the apex court refrained from passing any relief as the Delhi government, which is probing the murder case, has not been made a party to the bail plea. The bench then issued notices to the Delhi and UP police for their response on the bail application.
