As the Centre declares that no Indian has the Right to Privacy under the Constitution, distinguished Constitutional experts disagree.
During a hearing on the Aadhar scheme on Wednesday, July 22, the counsel for the Union government told the Supreme Court, 'Citizens don't have the right to privacy under the Constitution.'
Two distinguished Constitutional experts do not agree with this argument.
"This is an incorrect statement," Supreme Court lawyer Anil Divan tells Rediff.com
"The Right to Privacy is guaranteed under Article 21, as interpreted by the Supreme Court," explains Divan.
"The Supreme Court, in the case of R Rajagopal versus the State of Tamil Nadu," Constitutional expert P P Rao tells Rediff.com, has ruled that "the Right to Privacy is the Right to Live with Dignity under Article 21 of the Constitution."
