India files plea in Malaysian court for Quattrocchi's extradition

Vandana Saxena in Kuala Lumpur | May 13, 2003 20:10 IST

India on Tuesday filed a petition in Malaysia's Federal Court seeking a review of dismissal of its plea for the extradition of Italian businessman Ottavio Quattrocchi to stand trial in the Bofors gun deal case.

"We have filed an appeal against the judgment of the Court of Appeal and the notice has already been served on Quattrocchi's lawyers," said a lawyer involved in the case.

If the Federal Court decides the matter in favour of India the case may be referred to the Court of Appeal. Otherwise India will have to make a fresh request and furnish the required documents at the beginning itself, the lawyer said.

Attorney General of Malaysia, whose office has been fighting the case on behalf of India, filed the appeal before the country's highest court.

The Court of Appeal on April 30 rejected India's request for a review of a lower court ruling dismissing its plea for Quattrochi's extradition.

Quattrocchi has a residence and business in Malaysia, but is presently in Italy.
