Birla files caveat against Lodha

July 16, 2004 20:00 IST

Even after making it clear that the Birla family wanted the M P Birla group's assets to go to a charitable trust, Yashovardhan Birla, the youngest in the clan, on Friday filed a caveat in the probate section of the District Judges Court in Kolkata.

Yashovardhan Birla is the grandson of M P Birla's brother Gajanan Birla and son of Ashok Vardhan Birla.

The caveat would ensure that Birlas were given an opportunity to present their views if Rajendra Lodha, who was bequeathed the over Rs 5,000 crore (Rs 50 billion) assets of M P Birla group as per a will made by the late Priyamvada Birla, moved to probate it.

  • The caveat was filed on behalf of Birla by advocates Niraj Jhunjhunwala, V Jhunjhunwala and Amalesh Kanti Ghoshal in the afternoon, sources told PTI.

This was the second caveat filed by Birla family after the controversy arose with the one filed in Calcutta High Court on July 14.

The Birla family had served a notice on Wednesday to Rajendra Lodha to provide them within next 24 hours a certified copy of the will made public on July 12.

Sources close to the family confirmed that they were yet to receive a copy of the will from Lodha despite the legal notice.

Under the circumstances, it appears that Birlas' might have to move court to get an order to force Lodha provide them a copy of the will. However, Birlas have so far not given any indication to this effect.
