Bihar Assembly dissolution: File response within 3 weeks, SC tells Centre, governor

The Supreme Court on Monday issued notices to the Centre and Bihar governor accepting that former National Democratic Alliance legislators challenging the decision to dissolve the Assembly 'have made out a case for hearing'.

The court repeatedly asked as to what all materials were transmitted to the President for his subjective satisfaction before dissolution of the Bihar Assembly under Article 356 of the Constitution.

The court asked the Centre and Bihar governor to file their responses within three weeks.

Appearing for the Centre, senior advocate Gopal Subramanium said all those reports, which were required to be transmitted according to the prevailing procedures, were sent to the President's Secretariat in Delhi on May 22.

When asked about the proof of transmission, the counsel said the proof was with the President's office.
