Ayodhya case: UP govt won't revive
proceedings against Advani, others

Uttar Pradesh Chief Minister Mayawati on Tuesday decided not to issue a fresh notification for revival of a special court conducting proceedings against Deputy Prime Minister Lal Kishenchand Advani and 20 other leaders of the Bharatiya Janata Party and Vishwa Hindu Parishad in the Babri Masjid demolition case.

"After detailed scrutiny and discussion with legal experts, I arrived at the conclusion that there was no need for issue of a fresh notification," she said at a press conference in Lucknow.

In all, 49 people were charged with being involved in the demolition of the mosque on December 6, 1992. They included Union Human Resources Development Minister Murli Manohar Joshi, Coal Minister Uma Bharti, Shiv Sena chief Bal Thackeray, VHP president Ashok Singhal and president of the BJP's UP unit Vinay Katiyar.

A Faizabad court was hearing the criminal case against the accused. But, later in 1993, the state government issued a notification to constitute a special CBI court to expedite the case.

In 2001, the Lucknow bench of the Allahabad high court, however, set aside the constitution of the special CBI court on technical grounds. The judge said the government did not fulfil the mandatory requirement of seeking the permission of the chief justice of the Allahabad high court before issuing the notification for the constitution of the special court.

The bench had, however, held that the criminal proceedings could be revived if the state government issued a fresh notification.
