Shivani case: Court dismiss plea
for probing role of high-ups

A Delhi court on Friday dismissed the plea of R K Sharma, prime suspect in the murder of Indian Express journalist Shivani Bhatnagar, for a direction to the Delhi police to probe the alleged role played by 'highly placed political persons' in the incident.

The court also ordered the 'unconditional release' of Sharma's property attached by the police.

In his application filed on October 8, Sharma had contended that he had revealed the names of some highly placed politicians allegedly connected with the journalist's murder.

Claiming that the police had completely ignored the 'cogent and trustworthy leads and information', he urged the court to direct the investigating agency to pursue the leads.

However, Metropolitan Magistrate J P Narain said he cannot direct the police as to the manner in which investigations should be conducted.

On a separate application seeking release of Sharma's property, Special Public Prosecutor S K Saxena said the same may be allowed subject to the condition that it shall not be sold, mortgaged or disposed off.

This would make available the property for recovery of compensation to be awarded to the kin of the victim in case of Sharma's conviction, he said.

However, the court ordered unconditional release of all of Sharma's property that has been attached.

The court also rejected two contempt applications seeking action against the police for not allowing Sharma's family to meet him in custody and for not intimating co-accused Ved Prakash Sharma's counsel about his client's interrogation.
