The judicial magistrate first class in Patna has issued a non-bailable arrest warrant for Lieutenant General (retired) Jagjit Singh Aurora, hero of the 1971 war with Pakistan, on charges of cheating and breach of trust.
Gen Aurora, the man before whom Pakistani forces surrendered in Dacca, Bangladesh, on December 16, 1971, has filed a petition before the sessions judge, Patna, seeking anticipatory bail. The court has fixed August 14 for hearing his plea.
Magistrate Bhanu Pratap Singh issued the arrest warrant following a complaint accusing the general of cheating, misappropriation, and criminal breach of trust.
According to Mohammed Kamran, counsel for the complainant, the case relates to the alleged non-refund of deposits made in a financial company, Hindustan Financial Management Limited, of which Gen Aurora was chairman.
Mohar Lal Majhi, an undersecretary in Jharkhand's department of mines, had filed a criminal complaint against the general and seven others in February 2001.
In his complaint, Majhi said he and his wife had deposited Rs 1,72,000 in two separate schemes with the New Delhi-based HFML.
They deposited Rs 92,000 in one scheme in May 1997, repayable along with Rs 92,254 as interest in the year 2000. In another scheme in August-September 1997, the couple deposited Rs 86,000, to be repaid with Rs 24,000 as interest in April 1999.
But so far the Majhis have not even got their principal back, never mind the interest, Kamran said.
In his application, Gen Aurora has said that he deserves bail as a hero of the 1971 war.
