The Union Cabinet on Friday decided to set up a commission of inquiry under the Commission of Inquiry Act 1952 to probe the tehelka.com expose. according to Parliamentary Affairs Minister Pramod Mahajan. Prime Minister A B Vajpayee, in his address on Doordarshan, also made the announcement.

Briefing reporters on the deliberations of the Union Cabinet meeting on Friday evening, Mahajan said the inquiry would look into the allegations made in the video tapes and transcripts released by tehelka.com under the codename of Operation West End.

The proposed commission of inquiry, according to Mahajan, will be a single-member commission and will consist of a sitting or a retired judge, preferably sitting, of the Supreme Court.

The judge will be appointed after consultations with the Chief Justice of India.

The commission will be asked to submit its report within four months of notification.

The following are its terms of reference: a)

  • To inquire into the transactions relating to defence and other procurements referred to in the said videotapes and transcripts to ascertain whether they have been carried out in the terms of the prescribed procedures and imperatives of the national security;
  • b) To inquire whether any of the aforesaid procurements, transactions or illicit gains have been made by persons in public office, individuals or any other organisation alleged and if so to what extent;
  • c) To suggest action that may be taken in respect of the persons who may be found responsible by the commission for their acts of commission and/or omission in respect of the transactions referred to in Term A;
  • d) To inquire into all aspects relating to making of the allegations or any other matter which arises from or is connected with or is incidental to any act, omission or transaction referred to in terms of reference A and B. e)
