Shah contends tapes have no legal value

Film financier and diamond king Bharat Shah's advocates Friday informed a designated court that his alleged telephonic conversation with Chhota Shakeel does not have any legal validity and cannot be used as an evidence against him.

A battery of lawyers led by V R Manohar told additional sessions judge A P Bangale, who presides over the special Maharashtra Control for Organised Crime Act that permission for interception of telephone calls was not granted as per law and therefore the tape had no legal value and could not be used against their client.

Manohar, who was accompanied by advocates Shiraj Rehamutalla and Vaibhav Krishna, while moving the bail application, informed the court that 15 pages of the first information report, furnished to the accused, did not refer to Shah, except Shakeel and Naseem rizvi, the producer of Chori Chori Chupke Chupke.

The court was also informed that the FIR does not disclose anything about the alleged telephonic conversation which took place on October 22.

The arguments will continue on Monday.

Shah was arrested by the Bombay police on January 8 for alleged links with Karachi-based gangster Chhota Shakeel. Besides Shah, producer Rizvi is also booked under the MCOCA and both are at the Aurthur Road jail.
