Retd SC judge Kurdukar to probe Enron deal

The Democratic Front Government in Maharashtra has appointed retired Supreme Court judge Sudhakar Kurdukar to head the judicial probe into the controversial power purchase agreement with US energy major Enron.

"Kurdukar will be submitting his report within six months after notification of his appointment is issued," Chief Minister Vilasrao Deshmukh told reporters after a cabinet meeting in Bombay on Wednesday.

Kurdukar was Chief Justice of Punjab high court before he assumed his position in the apex court.

Asked what if Kurdukar fails to submit his report within the prescribed time-frame, Deshmukh said, "then we will have to extend the time limit for him."

The cabinet had already approved the judicial probe after a decision to institute a judicial inquiry was taken in the co-ordination committee of the DF.

To a query about Enron's Dabhol Power Company demanding a 'written undertaking' from the state government that it will not file a civil suit against the multinational as it was not a party to the PPA, Deshmukh said, "we are moving the London court and a decision in this regard will be taken there."

Earlier, the government had announced that it would move against the order of Queen's Court in London, which had issued an injunction restraining the state from filing a suit in India against the on-going international proceedings.
