Two years after a petition was filed seeking independent investigation into the functioning of BCCI and its accounts, the Delhi High Court has dismissed it on account of non-prosecution.

A bench comprising Chief Justice B C Patel and B D Ahmed dismissed the Public Interest Litigation filed (PIL) in April 2000 alleging that the apex body of cricket in India and its member associations were functioning in an arbitrary and opaque manner.

The Court dismissed the petition as neither the petitioner nor his counsel appeared for hearing on Friday.

The petition filed by two cricket lovers, Rahul Mehra and Shantanu Sharma had sought investigation into BCCI's account for the past five years from the date of filing the PIL contending that the BCCI and its other member associations were functioning as private empires of some businessmen and traders, who have come to control and abuse cricket for their own interest and profit.

The PIL had alleged that BCCI and its member associations were acting contrary to the objectives for which they were created and the development and promotion of the game was suffering at the cost of board functionaries.

The petitioners had sought audit of the accounts of BCCI and other member association by Comptroller and Auditor General (CAG).
