Centre gets notice in US hit-and-run case

An Indian court on Monday issued a notice to the Centre on the bail plea of a Mumbai-based fugitive, arrested over an extradition request of the United States in a two-year-old hit-and-run case registered in New York.

Ganesh Upendra Shinoy, who is in judicial custody following his arrest in Mumbai on June 29 after a non-bailable arrest warrant was issued against him, moved a bail application before Additional Chief Metropolitan Magistrate Kamini Lau.

The court issued notice to the Centre to put forward its opposition, if any, and fixed the matter for hearing on Tuesday.

Earlier, Shinoy, who was produced before a vacation court a day after his arrest, was sent to jail till July 5.

The request for extradition of accused was made by US Secretary of State Condoleezza Rice who had written a letter to the Ministry of External Affairs in this regard.

The MEA had moved the court on April 30, requesting it to initiate extradition proceedings against Shinoy, who has been charged with manslaughter of the second degree as per the US laws.

Shinoy fled United States two years ago after allegedly killing one Phillip Mastropolo while driving in New York on April 11, 2005.

A US court indicted him on the charge of manslaughter comparable to causing death by negligence under the Indian laws.

An arrest warrant was issued in the US against Shinoy on August 10, 2005.

After Shinoy evaded the law for two years, the US government sent the extradition request along with official documents and a certificate of authentication signed by Rice.
