Dec 16 rape case: 'The accused satisfied their lust... brutally!'

The accused in December 16 gangrape case were on the road in pursuance of a plan and targeted the victims, including the girl, in their "quest for sexual satisfaction and loot", committing a crime which was "grotesque to say the least", the prosecution told the court on Thursday.

"She (the girl) has clearly given the details of the incident in the bus (in her three dying declarations)...The brutality was grotesque to say the least," Special Public Prosecutor Dayan Krishnan said in his final arguments in the December 16 gangrape-cum-murder case before Additional Sessions Judge Yogesh Khanna in New Delhi.

"The modus operandi was a quest for sexual satisfaction and to loot the victims. They first enticed one Ramadhar and robbed him and threw him on road and also tries to run the bus over him.

"Similarly, they all lured the girl and the boy into the bus, making them believe that the vehicle is a public carriage and later assaulted them...," Krishnan said, while narrating the gruesome manner in which the girl was allegedly gangraped by the six accused, who had also assaulted her male friend and dumped them on road side without clothes on a winter night.

Terming the case different from other criminal cases, Krishnan said the grievous injuries inflicted on the victim themselves explain the "brutality" and extreme torture.

He said the accused were on capital roads in pursuance of a plan and "the moment the prey was in their net, they moved on to satisfy their lust".

According to the prosecution, Ram Singh, Vinay Sharma, Akshay Thakur, Pawan Gupta, Mukesh and also the juvenile, who was tried by the Juvenile Justice Board, had allegedly gangraped the girl in a moving bus after luring her and her 28-year-old male friend, who was also assaulted.

The victim's friend, a software engineer, fractured his limbs during the scuffle. The girl succumbed to her injuries on December 29, 2012 while undergoing treatment in a Singapore hospital.

During the trial, Ram Singh was found dead in Tihar Jail on March 11 and court proceedings against him stand abated.

The sixth accused, a juvenile, has been held guilty by the JJB of robbing the carpenter while the verdict in the gangrape case is likely to be pronounced on August 31.

The prosecution has examined 85 witnesses to prove its case against the four adult accused. The accused have brought 17 defence witnesses to strengthen their plea of alibi.

Reading out the girl's dying declarations and also the statement of her male friend, who is also the complainant in the case, Krishnan submitted that they both talk of the horrific night and the manner in which accused committed the crime.

"They (the victim and her friend) have talked about their abduction. She clearly talks of rape. She clearly talks about being thrown out of a moving bus and that the accused tried to crush them under the wheels.

"The prosecution case is much more corroborated with the statements of the prosecution witness (PW) No 1 (girl's friend) and the dying declaration of the victim," Krishnan said.

The prosecution said that the victims have boarded the bus from Munirka bus stand in south Delhi, which has also been proved by their witnesses and accused persons, who themselves have pointed out the place of occurrence.

"The factum of injuries clearly shows accused presence in the bus, which is also supported by the DNA report," Krishnan said, adding that accused had unnatural sex with the girl.

The final arguments on behalf of the prosecution remained inconclusive and will continue on Friday.
