Police files chargesheet in Jaitley phone tapping case

The Delhi police on Tuesday filed its charge sheet against four accused persons in connection with Bharatiya bleader Arun Jaitley's phone tapping case.

The special cell of the Delhi police filed the 32-page charge sheet before Chief Metropolitan Magistrate Amit Bansal, who took cognisance of the final report and posted the matter for further proceeding on April 30.

The police has named Delhi Police constable Arvind Dabas and three private detectives -- Anurag, Neeraj, and Nitish -- who all are in judicial custody in connection with the case.

The Investigating Officer told the court that they are yet to receive various forensic reports and the records of the mobile service provider, after which the court directed the police to expedite their investigation.

"The IO has submitted that the report from the FSL, CFSL and mobile service operators is yet to be submitted. The IO is directed to expedite (the probe) and file the said reports on record at the earliest. IO is already directed to supply the copy of charge sheet and documents to all the four accused persons," the CMM said.

The police in its chargesheet has booked the accused under sections 420 (cheating), 464 (making a false document), 467 (forgery of a valuable security), 468 (forgery for the

purpose of cheating) and 471 (using as genuine a forged document) and 120B (criminal conspiracy) of the IPC and under section 66 of the Information Technology Act. The police has filed around 1,000 pages of documents along with the charge sheet and has named 36 persons as prosecution witnesses in the case.

Dabas was arrested on February 14 for allegedly trying to access Jaitley's call details. According to police, Dabas had used the official email ID of an Assistant Commissioner  of Police to send a request to a mobile service provider for the call detail records of the senior BJP leader.

Neeraj was arrested by the police on February 18, while the other two accused, Anurag and Nitish were taken into custody on February 19

Earlier, the police had told the court that during the ongoing probe, it has come to light that call detail records of 30 other persons have also been collected by the four accused and in most of the cases, the Internet protocol address of Dabas was used.

The special cell of the Delhi police had also told the court that password of the official email ID of the ACP was taken unauthorisedly by Dabas at the time when he was posted in special staff and he had collected the CDRs in some cases while he had also attempted to get more records which only the authorised person could have collected.

The police had said that the four accused had induced the telecom service providers to provide CDRs of various persons, including Jaitley, to them and they, in an organised manner, have impinged upon and attacked the personal liberty of a sitting member of Parliament and others.

Dabas' lawyer had opposed the claims of the police and had told the court that the ACP's role should also be thoroughly investigated and the case was not about phone tapping but it was about unauthorised procurement of the CDRs.

He had also said there was no direct evidence against his client and he was falsely implicated in the case by the police. The core committee on Bihar comprises Modi, Bihar BJP President Mangal Pandey, former Union minister and BJP National Vice President C P Thakur, state ministers -- Nandkishore Yadav, Ashwani Choubey -- MP Radha Mohan Singh and Nagendra Singh.

BJP's national leaders Ravi Shankar Prasad, Rajiv Pratap Rudy and Shahnawaz Hussain, all hailing from Bihar, would also attend crucial core committee meeting on April 18.         

Stating that the all BJP workers were 'agonised' over the unfortunate episode in the last few days, he said the NDA constituents should concentrate it energy in overthrowing UPA rule instead of raising accusing fingers on each other.

Modi, considered as the architect of BJP and JD-U alliance government in Bihar, made these reactions after he spend time with Chief Minister Nitish Kumar during 30th foundation day function of COMFED, state dairy cooperative.

Apart from reading his statement Modi refused to answer any question on continuation of alliance and other issues.
