Gujarat HC allows Muslim youth OBC status

The Gujarat High court has quashed the order of the Director of Developing Caste Welfare Department, which had cancelled the Other Backward Classes caste certificate of a Muslim youth of Julaya community and asked the department to review the case.

The petition was filed by one Mohammad Akbar belonging to Julaya community whose Other Backward Caste certificate was cancelled following the order of DCWD. The Gujarat High Court Judge Justice Akil Qureshi on Thursday directed DCWD to review the case, the counsel for the petitioner said in Ahmedabad on Friday.

The Julaya (weavers) community has been identified by the state government in 1978 as Baxi Panch belonging to OBC, advocate for the petitioner Mukul Sinha said.

However, for the last three years the government, through DCWD had scrutinised the OBC status of different communities and a large number of their caste certificates were cancelled. DCWD in the year 2005 had cancelled the caste certificates of Momins of Dholka town saying that they did not belong to Julaya caste which led to filing of the petition before the High Court by one Mohammad Akbar, Sinha said.
