A Delhi court on Monday dismissed a complaint accusing Prime Minister Narendra Modi of 'insulting' the national flag in 2015 on the international yoga day and later during his visit to the United States.
Additional Chief Metropolitan Magistrate Samar Vishal rejected the plea for lodging a first information report under relevant provisions, noting that the complainant has already passed away.
The court had on March 24 noted that notice issued to the complainant, Ashish Sharma, was received back with the report that he had passed away.
"The court notice issued to the complainant received back with the report that he has passed away in March 2017.
"It is pertinent to mention that the complainant is not appearing in this case," the court had noted on March 24.
The detailed copy of Monday's order, however, was not available.
The complainant had alleged that the Prime Minister had committed an offence under the provisions of Prevention of Insults to National Honour Act, 1971 and had also violated the Flag Code of India.
He had alleged that the Prime Minister had insulted the national flag not once but several times, adding that he had 'disrespected' the national flag at the event of Yoga Day at the India Gate on the international yoga day by using it as a handkerchief.
'He (Modi) was again careless at the time of handing over the national flag to Barack Obama, President, USA, when he signed over the national flag which is against National Flag Code, 2002,' the complaint had said.
