Supreme Court acquits Kalpanath Rai
The two-year court ordeal of former Union minister Kalpanath Rai ended today when the Supreme Court cleared him of charges under the Terrorists and Disruptive (Prevention) Act.
The judgment was pronounced by a division bench comprising
Justices M K Mukherjee and K T Thomas.
The court also acquitted five other co-accused, who were also charged with harbouring one of the accused in the September 1992 J J Hospital shootout case in Bombay. Among them are Rai's personal assistant S P Rai, East West Travel and Trade Links Limited and Subhash Thakur gang member Mohammadd Ahmed Mansoor.
Setting aside the conviction of four other accused by the TADA court, the judges sentenced them under section five of the Act for possessing unauthorised arms in a notified area. They issued notices to the accused, including Subhash Thakur, Jayendra Thakur alias Bhai Thakur of the Dawood Ibrahim gang in this regard.
The court said the prosecution has failed to establish the charges of harbouring a terrorist against them.
