Patna HC dismisses petition against PM

The Patna high court on Monday dismissed a PIL challenging continuance of Manmohan Singh [Images] as prime minister, despite not being a member of the Lok Sabha and slapped a fine of Rs 10,000 on the advocate for filing such a "frivolous" petition.

A division bench of the court comprising Justices Narayan Roy and M Sharan dismissed the PIL filed by advocate Shruti Singh and imposed the fine on her.

"Such frivolous PILs should not be filed. This merits imposition of a fine in order to discourage the practice of filing frivolous litigations," the judges said announcing their brief order.

Advocate Shruti Singh had filed the PIL earlier this year seeking the court's intervention for ousting Dr Singh from office as he was not a member of the Lok Sabha.

The prime minister, government of India, the Bihar government, secretary to the ministry of law and justice, Rajya Sabha, Lok Sabha and the Election Commission of India were made respondents.
