21. In pursuance of the aforesaid conspiracy, the said accused persons advocated, abetted, advised and incited the Indian Muslim youths and knowingly facilitated the commission of terrorist act to wit cause bomb explosions in seven first class compartments of western railway trains in Mumbai on 11.07.2006. Accused persons namely (1) Asif Khan Bashir Khan @ Junaid (A-13), (2) Mohd Faisal Ataur Rehman Shaikh (A-3), (3) Dr Tanveer Ahmed Mohammed Ibrahim Ansari (A-2), (4) Ehtesham Kutubuddin Siddiqui (A-4), (5) Suhail Mehmood Shaikh (A-10), (6) Zameer Ahmed Latifur Rehman Shaikh (A-11), (7) Mohammed Sajid Margub Ansari (A-7), (8) Abdul Wahid Din Mohammed Shaikh (A-8), (9) Shaikh Mohammed Ali Alam Shaikh (A-6), (10) Muzzammil Ataur Rehman Shiakh (A-9), (11) Rizwan Mohammed Dawrey and (12) Rahil Ataur Rehman Shaikh continued to be members of “Students’ Islamic Movement of India” and remained in contact wiht wanted accused Azam Chima, commander of Lashkar-e-Toiba, both banned terrorist outfits, as declared by the Government of India in the schedule as laid down under section 2 (1) (m) and 35 of Unlawful Activities (Prevention) Act-1967

22. Investigations have disclosed that accused Asif Khan Bashir Khan @ Junaid (A-13) is one of the key conspirators continuously indulging in committing terrorist acts and unlawful activities for and on behalf of SIMI, an organization banned by the Government of India since 27.09.2001. In the year 1999, a case U/s 153 (1) (A), 34 IPC was registered at MIDC Police Station, Jalgaon, Maharashtra vide CR No. 178/1999 against him. The Hon’ble Court had taken cognizance of the said ase vide CC No. 219/2001. In this case Asif Khan Bashir Khan (A-13) was declared as proclaimed offender on 08.03.2002. While he was so absconding, another case was registered against him by the MIDC Police Station, Jalgaon, Maharashtra vide CR NO 103/2001 U/s 153 A, 121, 121-A, 122, 123, 201, 506 (II), 120-B, 34 IPC r/w Sec 4 (a) and 4 (b) and 5 of Explosive Substances Act. In the said case too, Asif Khan Bashir Khan @ Junaid (A-13) evaded arrest and remained absconding till his arrest in this case. The six co-accused in the said case have since been convicted for various terms ranging from 3 years to 10 years vide SC No 126/2002.

23. That in pursuance of the aforesaid conspiracy, between February and May 2006 arrested accused persons held several conspiratorial meetings in the house of arrested accused Mohd Faisal Ataur Rehman Shaikh (A-3) at Bandra (W), Mumbai near Shams Masjid, Mira Road, Dist: Thane and at 101, Saba Parveen Apartment, Pooja Nagar Road, Naya Nagar, Mira Road (E), Thane ie house of arrested accused Mohd Sajid Margub Ansari (A-7). The said meetings were attended by accused persons (1) Asif Khan Bashir Khan @ Junaid (A-13), (2) Suhail Mehmood Shaikh (A-10), (3) Mohd Faisal Ataur Rehman Shaikh (A-3), (4) Ehtesham Kutubuddin Siddiqui, (5) Dr Tanveer Ahmed Mohd Ibrahim Ansari (A-2), (6) Muzzammil Ataur Rehman Shaikh (A-9) and (7) Zameer Latif Ur Rehman Shaikh (A-11), (8) Naveed Hussain Khan Rashid Hussain Khan (A-12) (9) Shaikh Mohammed Ali Alam Shaikh (A-6) and (10) Sajid Margub Ansari (A-7). In the said meetings it was deided to survey and select targets for causing large scale explosions.

24.That in pursuance of the aforesaid conspiracy and in order to achieve the object of conspiracy, during May 2006, wanted accused Azam Chima asked arrested accused Mohd. Faisal Ataur Rehman Shiakh (A-3) to identify likely targets to cause large scale damae and fear in the midns of general citizens. Accordingly, arrested accused (1) Mohd Faisal Ataur Rehman Shaikh (A-3), (2) Zameer Ahmed Latifur Rehman Shaikh (A-11) and (3) Suhail Mehmood Shaikh (A-10) surveyed places like World Trade Centre, Mumbai Stock Exchange, Mahalaxmi Temple, Siddhi Vinayak Temple, local trains and some large shopping complexes. Except for the local trains, the conspirators avoided the other targets as all the sais places had tight security arrangements. Mohd Faisal Shaikh (A-3) informed wanted accused Azam Chima that local trains were crowded and soft target and hence, suitable for causing explosions.

25.That in pursuance of the said conspiracy and in order to achieve objectives of the conspiracy, on the evening of 10.07.2006, accused persons namely (1) Shaikh Mohammed Ali Alam Shaikh (A-6), (2) Mohd Faisal Ataur Rehman Shaikh (A-3), (3) Naveed Hussain Khan Rashid Hussain Khan (A-12), (4) Sohail Shiakh, Pakistani national and one unknown Pakistani national, transported seven Rexene bags containing explosive devices from the house of arrested accused Shaikh Mohammed ali Alam Shikh (A-6) i.e. Plot No 33, T Line, Room NO.2, Shivaji Nagar, Govandi, Mumbai-43 to Flat No.24, Lucky Villa, Perry Cross Road, Kant Wadi, Bandra (W), Mumbai-50 i.e. house of arrested accused Mohd. Faisal Ataur Rehman Shaikh (A-3) in his M/Car nO MH-01-V-9568 and one M/Taxi.

26. That in pursuance of the said conspiracy and in order to achieve objectives of the conspiracy on 11.07.2006 between 15.00 hrs and 16.30 hrs. arrested accused persons namely (1) Ehtesham Kutubuddin Sidiqui (A-4), (2) Naeed Hussain Khan Rashid Hussain Khan (A-12), (3) Asif Khan Bashir Khan @ Junaid (A-13), (4) Mohd Faisal Ataur Rehman Shaikh (A-3) and (5) Kamal Ahmed Ansari (A-1) and wanted accused (1) Aafijullah, (2) Aslam, (3) Salim, (4) Ammu Jaan, (5) Abu Umed @ Abu Osama, (6) Sabir, (7) Abu Bakr traveled with the seven bags containing explosive devices from Flat No. 24, Lucky Villa, Perry Cross Road, Kant Wadi, Bandra (), Mumbai-50 i.e. house of arrested accused Mohd Faisal Ataur Rehman Shaikh (A-3) in different M/Taxis to Churchgate Railway Station on Western railway.

27.That in pursuance of the said conspiracy and in order to achieve objective of the conspiracy the accused persons mentioned planted explosive devices in the first class compartments of local trains as under:
