Kerala MP P C Thomas disqualified

The Kerala High Court on Tuesday declared as void the election of former Union minister P C Thomas from the Muvattupuzha Lok Sabha constituency in Kerala.

The court also declared Communist Party of India (Marxist) leader P M Ismail elected from the seat. The 81-page judgment was delivered by Justice C N Ramachandran Nair in response to an election petition filed by Ismail, who challenged Thomas's election in Lok Sabha polls held on May 10, 2004.

Thomas had been elected by 529 votes. The court held that Thomas had indulged in corrupt practices in the polls. Thomas, who contested the election as a candidate of the Indian Federal Democratic Party, recently joined the Kerala Congress-Joseph. He was the minister of state for law in the Bharatiya Janata Party-led National Democratic Alliance government. 

Ismail had accused Thomas of asking for votes on religious grounds. He allegedly published a calendar containing his photograph along with pictures of the Pope and Mother Teresa.

Pamphlets appealing to the religious minorities were printed by Thomas, the petitioner said, adding that his election expenses had exceeded permissible limits. Also, vehicles hired by his supporters had transported voters to polling booths free of cost.

These actions of Thomas constituted corrupt practices under the Representation of Peoples Act and therefore his election should be declared void, the petitioner said.

They can be religious. They used Pope and Mother Theresa not on religious grounds, but on minority grounds. Comeon Muslim league and Kerala Congresss(Christian Party) ...
