SC dismisses petition on Bihar MLAs' salary

The Supreme Court on Monday dismissed a petition that requested the court to direct the Bihar administration to disburse salary and allowances to legislators.

Under a state law, the legislators are barred from the benefit till they take oath.

A bench comprising Chief Justice R C Lahoti and Justice G P Mathur declined to entertain the petition.

The bench said the MLA could approach the high court concerned.

Bharatiya Janata Party member of Legislative Assembly Rameshwar Prasad filed the petition.

He said the provision of the Bihar Legislature Member Salary Act, 1960, which barred the disbursement of salaries and allowances to the MLAs till they took oath, was unconstitutional.
