Mumbai HC dismisses petition seeking production of MLAs

The Mumbai high court on Tuesday dismissed a habeas corpus petition urging for the production of Nationalist Congress Party and Congress legislators before the judiciary to ascertain whether they were illegally detained by their parties.

The petition, filed by Nagpur-based journalist Krishna Dorlikar, was dismissed by Justice D G Deshmukh and Justice A S Aguiar who observed that he had no locus standi in the matter.

Advocate General Goolam Vahanvati argued that a habeas corpus petition could only be filed by relatives or friends of the concerned legislators and not by the petitioner in his capacity as a member of the public.

Upholding the advocate general's argument, the court held that the petition was not maintainable.

The petitioner's counsel, Falguni Bhrambhatt, had urged for a direction to produce the legislators within 24 hours to ascertain whether they had been wrongfully held by their parties.

The respondents to the petition were the Government of Maharashtra, Chief Minister Vilas Deshmukh, Deputy Chief Minister Chhagan Bhujbal and NCP president Sharad Pawar.

The petition blamed the respondents for the existing political chaos in Maharashtra.
