An all-party meeting on Monday rejected the Election Commission move to implement the Supreme Court directive asking candidates to disclose their antecedents, instead asking the government to bring out a comprehensive legislation to 'curb criminalisation of politics' and 'bring in probity in public life'.

Are the politicians correct, or is this just an attempt to ensure that `tainted' candidates are not debarred?

Your Views: These beggars are looting the public and the exchequer. All these fellows must be shot dead. By rejecting the SC advice, what they are effectively saying is that they will amass wealth through corrupt means, not pay taxes, indulge in all types of social, political, economic and criminal activities such as communal riots, political skullduggery, tax evasion, arson, looting, rape and get away with it all. With these b....... as parliamentarians, India is doomed. The only way to clip their wings is mass action and counter arson against this class by the common man (for a change) and disenfranchising the illiterate and non - tax payers as they do not have a stake in the govt. Once that happens, there will be an automatic improvement in the living conditions of the really poor. Until then, poor, lower middle class, middle class and salaried class people can live in India only like condemned dogs.

Your Views: Caeser's wife should be above suspicion. If our elected representatives have failed so far to inspire confidence by their own actions, then it is for the judiciary to "restore" the balance. No one doubts that making laws are a legislative privilege, but no one (except the legislature, obviously) resents the executive or the judiciary laying down the law as required. In fact, if there is one species which is construed to have low, or no morals at all, it is the legislature. So if they do not regulate themselves, then someone must do it for them. In fact, all our representatives must be made to mandatorily declare their assets, verified by the Income tax department, both before and after leaving the elected post. So far as criminal records is concerned, all prospective candidates should be asked to declare their record, duly verified by the local High Court in advance of standing for election. Anyone who has been convicted of any crime, civil or criminal, should be barred from contesting for the next 5 years. Then may it be a traffic accident violation, or murder, or a simple cheque dishonour. Let's hope that the new legislation contains the same strict rules that are being opposed

Your Views: This is just another attempt by all political parties to ensure that one law governs them, and another governs the rest of the nation. Politicians get away with murder, rape, embezzlement, fraud, assault etc by chanting the mantra of "political conspiracy". For the rest of the Indians, being second class citizens, we have no such luck. India as a nation is cursed to have the worst possible kind of politicians, and it is true that as a nation we deserve the politicians we have.

Your Views: This is a very welcome step by the EC. As every educated person understands today, corruption has reached it's height in the political system of the country. Basically all the political parties are accomplices in the collective crime. It's just an attempt (as usual lately) to protect the vested interests of the fraternity. It's high time that the parties and politicians realize the effects of such attempts, or else the common man, who today is at the limit of his patience will soon come out on streets for a civil uprising.

Your Views: The all party meeting has exposed the "respect" the political parties across the board claim to have. The outcome of the meeting is no different from them who openly said that they will not obey the court's orders on certain sensitive issues. The ruling of the supreme court is a death bell for the casteist parties like RJD and SP. Their opposition can be understood as they will virtually be out if electoral scene as majority of their candidates come from tainted and criminal backgrounds. What is surprising is that the self proclaimed intellectuals like left parties, who always give sermons to Hindus to obey the court orders on an issue of faith, are mum on this and supporting the suppression of court orders. This has brought out how hypocritical our so called "secular" parties are.

BJP shows that it is part of other political parties, but at the same time, has quietly allowed the supreme court judgment to go ahead without being appealed. Your Views: The sheer fact that all parties came together, not for the women's bill, not for an education bill, but to attack a law that aimed at preventing criminals from acquiring position of political importance in the country, shows how politics has entered the clutches of the mafia. These vermin need to be shown their place and I hope there is some law that EC can use to beat them at their own game. Amazing to see many stars of the "Lotus that stays pure in sewage" party have come against this requirement. If their only grouse is against "misuse" of power by local Election Commission officers who could reject nominations, let them come forth for some kind of amendment to provide accountability and integrity to the process, why thwart a clearly progressive move that would help India a long way in improving its standing in the world community?

Your Views: It is beyond question that Parliament has the responsibility to frame legislation and they have to do so. In this case the legislation is directly affecting the legislators themselves and so the views/directives of a neutral authority such as Supreme Court is very essential. They have no right to reject the SC directive. SC directive should be implemented immediately and we the people and press have to make sure that the new legislation is in the same lines and spirit as the SC directive. We should not allow the rules to be diluted.

Your Views: Attitude reflects the intention. Really, if our so called bonafide law makers are interested to curb criminalisation of politics then by now they could have framed the law and could have got it implemented. But they do not want to do this, which is evident from their inaction for the last several years in this regard. That is why judiciary had to come for this. Frankly speaking to-day no political party can claim (if at all they have conscience !) that his/her party is free from criminals. Then why should we expect that our politicians would like to harm their own fellows by framing certain laws? It is something like telling Pervez Musharraf to frame a law for anti-infiltration! Indeed a very sorry state of affairs. I am personally very much disappoined by seeing the shallowness of character of the so called "bhagya vidhata of 100 crores of population".

The decision by the politicians is certainly condemnable. They have directly attacked the freedom of voters. BJP's stand that only the candidates elected should be asked for the details is very baseless. I think under all circumstances the transparency between the people and the candidate should be maintained. In India as many people are not aware of their right of questioning the history of the candidate, so it is full responsibility of the parliament to ensure that even such people get to know everything about the Candidates. The act of Parliament is deeply condemnable under all circumstances.

Today a learned man thinks thousand times before contesting election. In India, we can not get a government service, if we have any police case, but the leader who will guide the nation, does not require the same, here it comes to conviction of the candidate. And we all know what Jaylalitha done to the judgment of rejecting her candidature for contesting election. She appointed a puppet on the chair of CM, and occupied the seat after recontesting. God know how are they convicted and how they get freed. I think no politician has ever been sentenced to jail. Even if they go to jail, that is a holiday resort for them. Your Views: Here the question is, who will bell the cat? Where money & muscle power rules, there is no meaning preaching about cleansing the system. If the election commission tries to clean the system-a right step by all standards- the politicians are not interested because their survival is at stake. It is crystal clear that money and liquor flows in each elections from Panchayat level to Lok Sabha. There is no limitations for expenditure by candidates. A candidate securing 20% of the total valid votes is declared elected and is fit enough to rule us. Whereas a student scoring more than 75% marks is unable to find a seat in a college for higher studies. This is what our democracy is. Our rules and regulations are outdated and need to be updated as per the present day circumstances. Politicians are opposing this only for their advantage. NO politician after 1950 has shown any interest for the prosperity of this country. They are interested only in their welfare. If not, how come legislations seeking upward revision in their emoluments & perks are passed in the parliament without any objection? The real culprits are the electorate who choose incompetent netas and later feed them from his pocket.

Your Views: No Individual is above the Law and that includes our Law Makers. When they are making the laws then they should be the first to Respect and abide by them. If a President can be impeached for wrong doing (President Clinton almost was) then the Representatives of the People are also answerable for their actions. For too long the guardians of the Constitution have gotten away with unlawful acts and the people of this country have the right to have representatives who are Clean, Educated and Looked upon as First Class Citizens of the country. Not the type of people we have now. If a citizen is accountable for his/her actions then they should be too. There should be no preferential status for Representatives. The Court is right in their verdict and the Law Makers need to respect the judgment. If they do not, then the people should remove them and put others who will follow the directives of the Court. By rejecting the Court Order they are placing themselves above the Law - they do not have the right to do that and it is unfair to the masses who do. People Power is need to drill into these people that they have NO CHOICE but to follow the directive.

Your Views: Of course it has to be rejected! getting India ruled by a bunch of Mr Cleans is asking for too much. Besides, where will the present politicos go? Do you think they could be absorbed into the society if not the Tihar Jail? We don't want them there, we are better off with them inside the Parliament or their designated govt holes. Has anyone thought of the havoc this rule could wreak on us? Our news print media thrives on reporting their scandals and controversies., TV news will no longer have spice, half the country's lawyers will become jobless and there will be more number of judges in the bench than cases in the court, there will not be a coffin scam and the cattle in Bihar will turn lazy with too much of fodder! CBI and the IT sleuths will be rendered jobless and the police force disoriented., tax-payers money will deluge the govt vaults and central and state prisons will have acute shortage of space. Can you imagine an India like this? On the other hand, if the law does pass, our perfidious politicos will definitely find a way out.., a la Rabri devi or through the million other loopholes our Judiciary system offers in a platter! but hell, if the rule does pass..., WOW!!!

Your Views: I fully support the EC's directive. Politicians are after all the ugliest face of the society and should be severely punished if even the charges against them are not 100% substantiated. They should not be allowed the "benefit of doubt" under any conditions. I, for my life would like to see all the current corrupt crop of politicians behind bars without any access to the outside world kept in solitary confinement for their entire lifetime,which is what they deserve. All this talk of a "comprehensive Govt. legislation" to "curb criminalisation of politics" is just plain BS. I don't expect these criminals to indict themselves-it has to be done by someone "outside" party politics- like the EC. At least, if this EC directive is implemented, we can see on the papers full-fledged ads given by Lallo, Mullu, Jayalalitha, Karunanidhi,et al of what corruption they had done, what is their qualification (apart from rabble-rousing and indirect hands in many murders),etc., so that we can show to the foolish (m)asses who vote for them, what they really do. If not, our stupid illiterate folk will naively still think that a "vote" for these criminals means a "vote" for prosperity.

Your Views: There's nothing more to it than meets the eye. While the demanded 'comprehensive legislation to curb criminalisation of politics' is not unwelcome, the parties don't have any business to 'reject' or 'accept' any of Supreme court's directives. Why should the politicians be afraid to disclose their antecedents, is the question one asks. Also it is not that legislation to curb criminalisation of politics is not there. The present laws provide scope to deal with all criminals whether they be politicians or not. But we still see the kinds of Laloo Prasad Yadav, Jayalalithaa, etc. enjoying the most sacred positions in our democracy. So it will be a good idea to leave no scope for even a remote possibility for any public servant to misuse powers granted to him/her.

Your Views: Judicial activism is going extreme these years in India and there are many cases where they have blinded vision to the issue and many a times a romantic idealism about the problem .Political parties might be right about their apprehension of misuse of the power by the ruling party as it recently happened in the case of POTO application in Chennai to MDMK party. We are witnessing in Ahmedabad the gross violation of constitutional right of the commoner by the radical decision of One Justice who has banned power connection to the residential and commercial units which does not have B.U.permission. The court does not admit to the plea that inspite of request and readiness to pay the impact fee the Municipality is not at all agreed to issue B.U. And also a directive to the state government by the justice not to allow any new construction within the periphery of 1 km of any existing lake whether it has water or not. This has stranded many farmers and property holders who want to dispose away their property

Exceptions to this will only increase the number of anarchists and bandits in the legislatures ending up ruling the country and hold the people, economy, prosperity, diversity, culture, justice all to ransom. Your Views: first of all my congrats to the bunch of people who through PIL have brought the directive from supreme court about electoral reforms. Thanks to rediff for providing a space for discussion on these issues of paramount importance. Otherwise have you ever seen dharnas, rallies, or protests from the part of Indian public in any part of the country against this scourge of corruption.In fact I remind of one rally in Himachal Pradesh in support of Sukhram when he was convicted of corruption. It looks like that these days all rallies,protests are black money sponsored by politicians.All self-proclaimed patriots like people from RSS etc are now nowhere to be seen on these issues.They have never said any word about corruption. It seems that in our country all students unions etc are also have been bought by politicians. They would make fiery protests for futile issues but for this issue they will never do anything because they also do corruption and corruption has been so integrated in to society that no body feels like fighting for it. Your Views: The move by our political leaders to defeat the SC directive was all too predictable. The reality that crime, violence and corruption are the qualifying pre-requisites for any political aspirant is not lost on the khadi brigade. The memories of their past, I'm sure, must have made our politicians misty eyed with nostalgia during the proceedings to defeat this directive. We as an under-privileged working class of India have no right to destroy a tradition or make any move that makes such powerful and great leaders out of people who are otherwise morally and intellectually underpriviledged.

Your Views: No one is above the law. Not the lawmakers, or the law keepers. A ruling of the supreme court is law declared as per Art.141 of the constitution and the election commission was absolutely right in what it did. Until the law to be introduced is in force, the government can adopt the directives of the election commission. Any move against it would only tantamount to disobeying the orders of the supreme court and as a corollary disobey the law of the land. This is surely a step to mariginalise or reduce the impact of the order of the supreme court and in the meanwhile let the whole thing blow over. " tainted" candidates should be out if there has to be a semblance of democracy in the country especially at a time when the country is ready to make inroads as a major power and cross over from a developing country to a developed country, I say we have to provide the world with proof that we the Indians do not tolerate internal disintegration of values as much as we do not tolerate external aggression.

Your Views: It is definitely an attempt to ensure that tainted candidates are not debarred A new legislation will be reduced to just pieces of paper. If we do not want to act on it no meaning in making new legislation. For a change the Supreme court wanted to act and as usual it was stopped. The law says innocent until proven guilty in our politics the rule should be reversed. Politicians are all Guilty until proven innocent.

Your Views: Our countries leadership or political parties are spineless. Most of the India's problems are because of the corrupt politicians and criminal elements in them. Our countries problems will be reduced if these people do the right things. It is sad to see but not a surprise that they all unanimously oppose the supreme court directives on corruption. In our country school children are a lot good students than our politicians. Shame on them and pity ourselves.

Your Views: This requirement is nothing compared to the qualification needed in Singapore for a MP. In Singapore, the law for any person contesting MP election is that he/she should be a PG from a reputed university of the country and if he wants to be the minister then the other PG should be from the recognised university of the west. This are the qualification required for a person who wants to become a politician in a developed nation.

Your Views: The Supreme Court has no right to pass judgments over the Parliament, whether good or bad. As a democracy, Parliament should be supreme except that it cannot take away the 6 fundamental rights. Remember, the MPs have to face the people every 5 years or less whoever they are. For the better or worse, we'll have to leave these laws to the politicians and not to the courts. An Election Commission or a Supreme Court reflects only the view of a few high officials, as they interpret the law - the Parliament should have the final authority. If we are to continue as a democracy, there shouldn't be any authority over the Parliament.
