A petition has been filed against Bihar Chief Minister Rabri Devi and her husband Laloo Yadav in the court of the chief judicial magistrate in Patna for disrespecting the national anthem during the Republic Day function on January 26.
The petitioner, Niraj Kumar, a Samata Party leader, said that both of them have committed 'a criminal act' by insulting the national anthem.
"The conduct of Laloo and Rabri at the Republic Day function would endanger the nation's security," the petitioner said
The petitioner accused the duo of violating the provisions of the Prevention of Insults to National Honour Act, 1971, during the function.
The petitioner alleged that the duo remained seated at the time of unfurling of the national flag and when the national anthem was being sung.
Kumar further said in his petition that Chief Minister Rabri Devi had violated the Constitutional obligation that she had undertaken at the time of taking oath of office.
The petition said that it is settled principles of law, as has been held by the Supreme Court, that citizens have to stand up when the national anthem is being played.
