Afroz will be released on
Tuesday: Lawyer

Decks were cleared on Monday night for the release of suspected Al Qaeda terrorist, Mohammed Afroz Abdul Razak, from the Byculla prison after the registrar of the trial court issued a release memo ignoring police claims that the surety furnished by Afroz was not solvent.

The registrar accepted Kisan Vikas Patra worth Rs 100,000 from Afroz's father, Abdul Razak, and issued a release memo, which was deposited in Byculla prison at 8.30 pm.

Afroz will be released early in the morning on Tuesday, his lawyer Mubin Solkar said.

Earlier, despite securing bail from a special court, 26-year-old Afroz could not secure a release order from the Byculla prison.

Police informed designated judge A P Bhangale that the surety provided by Afroz, his house at Cheeta camp near Chembur, was worth only Rs 60,000. And since the court had asked him to provide a surety for Rs 100,000 it was not solvent.

On March 27, the court had directed police to apply its mind afresh on whether Mohammed Afroz could be tried under the Prevention of Terrorism Act or the Maharashtra Control of Organised Crime Act. The judge had also suggested that chargesheet may preferably be filed by April 9.
