HC throws out PIL on Tehelka

The Delhi High Court Friday took strong exception to an advocate filing a Public Interest Litigation on the Tehelka issue on the basis of newspaper reports and declined to take cognizance of it saying it has no "element" of public interest involved.

A division bench comprising Chief Justice Arijit Passayat and Justice D K Jain said "these type of petitions cause more damage to the national insterests."

Following the strong observations by the court, counsel for the petitioner withdrew the PIL, which had sought to restrain tehelka.com from using its news portal for activities which it alleged amounted to "demoralising" the armed forces.

The petition filed in the name of an organisation "Voice of People" alleged that the activities of Tehelka in making secret tapes on defence deals also amounted to its indulging in "criminal conspiracy" and "waging war against lawful government".

Besides Tehelka, the petitioner had also named the cabinet secretary, ministry of defence, ministry of information and broadcasting and the Delhi police commissioner as respondents.
