HC reduces bond amount in BMW case

Basharat Peer in New Delhi

The Delhi High Court Wednesday reduced the personal bond and surety for Sanjeev Nanda, the main accused in the BMW hit-and-run case, to leave the country, from Rs 450 million to Rs 190 million.

Hearing Nanda's application to reduce the personal bond of Rs 150 million and sureties worth Rs 300 million that the high court had asked him to deposit at an earlier hearing, Justice A K Sikri reduced the personal bond to Rs 50 million and sureties to Rs 140 million.

In the last hearing Nanda's counsel R K Anand pleaded that Nanda be allowed to go abroad as he was a British national and a clause in his employment contract required him to attend a workshop there.

Anand had cited the recent Supreme Court order in the Hinduja brothers case where they were allowed to go abroad after furnishing personal bonds and bank gaurantees worth Rs 450 million.

Justice Sondhi, who heard the case then, allowed Nanda to go abroad in case he was ready to furnish personal bonds and sureties worth Rs 450 million.

Nanda had agreed to it. But later after his father Suresh Nanda returned from England, the Nandas move an application in the court saying that they did not have the capacity to pay such a large amount.

Sanjeev Nanda's father Suresh, uncle Paul Nanda and grandfather, former navy chief S N Nanda will be giving the three sureties.

Nanda would have to deposit the sureties and personal bonds with the duty magistrate in the trial court at Patiala Courts by Wednesday evening or Thursday morning.
