Bibi Jagir Kaur granted bail

The Punjab and Haryana High Court Wednesday granted anticipatory bail to Bibi Jagir Kaur in the Harpreet Kaur murder case, that is being investigated by the Central Bureau of Investigation.

While granting bail Justice S S Nijjar said that he was not imposing any conditions on Kaur and left it to the CBI to impose any conditions that they might deem fit. "The court grants her anticipatory bail and directs her to appear before the CBI in Delhi 11 am on November 17," the judge said in his order.

The judge heard the arguments of CBI advocate R M Tewari and Kaur's advocate R S Cheema in a packed court.

The CBI advocate stressed that the CBI needs to interrogate Kaur as during investigations it has come to light that it was not a case of culpable homicide amounting to murder but it was a case or murder itself and hence the FIR has been suitably amended. The defence counsel said that his client was holding a high public office and there was little likelyhood of her absconding. He said his client feared that if she is arrested she would be pressurised to make confessions.

"She has justified grounds. Any citizen fears arrest by an investigating agency. Even if there has been a change in the section of the FIR it is not unusual. It is not an unprecedented case," the judge said while rejecting the CBI plea.

R S Cheema, advocate for Jagir Kaur, refused to comment saying that this is not the right time to say anything. Tewari seemed dissatisfied and said that he would consult the CBI top brass and move the Supreme Court against the high court order.

Jagir Kaur was not present in court.

A district and sessions judge had dismissed Kaur's anticipatory bail plea on November 13 ruling that her custodial interrogation was needed.
