Jaya I-T case to begin on Dec 27

The trial in an income tax case against former Tamil Nadu chief minister and All India Anna Dravida Munnetra Kazhagam general secretary J Jayalalitha will commence before the economic offences Court-I on December 27.

The judge Justice P Murugesan ordered issue of summons to witness V Srinivasan, who is assistant commissioner of income tax, to appear before the court on December 27 for recording his evidence, on an application filed by the income tax department.

After Jayalalitha willfully failed to file her income tax returns for the assessment year 1993-94, the I-T department had registered a case against her before the economic offences court. Challenging this, she filed a petition in Madras High Court, seeking quashing of the proceedings and an interim stay of it till the disposal of her petition.

The high court in 1996 granted an interim stay and the petition was still pending. When the case came up for hearing on November 23, the I-T department filed a petition, seeking to vacate the stay on the ground that it led to the pending of the case before the economic offences court for four years, thus making it impossible to commence trial proceedings.

The high court allowed the petition and vacated the stay.

When the case came up for hearing before the economic offences court on Thurday, the income tax filed a memo stating that the high court has vacated the stay and prayed to issue process to the witnesses for recording evidence.

It also filed an application seeking to summon Srinivasan, a witness for recording his evidence.

According to the I-T department for the assessment year 1993-94, Jayalalitha's income was Rs 10 million and the income tax due with interest now was over Rs 9.8 million.
