Swamy moves SC against Jain panel

Janata Party president Dr Subramanian Swamy today said he has filed a writ petition in the Supreme Court seeking quashing of adverse remarks about him in the final report of the Justice Milap Chand Jain Commission.

Dr Swamy told the media that his petition could come up for admission next week.

He described as "illegal" and "unconstitutional", the references about him in the report as an "unreliable witness". It was based on the testimony of some witnesses, because he was not given the mandatory notice under Section 8B and 8C under the Commissions of Inquiry Act before making any adverse remark. The notice would have enabled him to cross-examine hostile witnesses, he added.

Justice Jain, who probed the conspiracy aspects in the Rajiv Gandhi assassination case, was listed as one of the respondents.
