SC to hear DPC plea on MERC

The Supreme Court on Monday admitted an appeal filed by Enron promoted Dabhol Power Corporation challenging a Bombay high court order holding that the Maharashtra Electricity Regulatory Commission had exclusive jurisdiction to deal with the disputes between the power company and the Maharashtra State Electricity Board.

A Bench comprising Justice Y K Sabharwal and Justice B N Agrawal, while admitting the appeal filed by DPC, issued notices to the MSEB and MERC.

Meanwhile, the Union government, which had moved the Delhi high court and got an order restraining DPC from going ahead with the arbitration proceedings over invocation of Centre's counter guarantee for the power project in Maharashtra, requested the apex court to make it a necessary party in the appeal.

The Bench issued notice to the DPC on Centre's petition after hearing arguments from Attorney General Soli J Sorabjee.
