Delay likely in SC's Cogentrix hearing

The Supreme Court hearing in the Cogentrix thermal power project case of Karnataka is likely to be delayed further with Justice S K Kukurdukar withdrawing today from the three-judge bench headed by Justice S C Agrawal which had been hearing the matter.

The judge recused from the case forwarding personal reasons. The third judge on the bench was Justice S Rajendra Babu.

Now, a new bench would have to constituted by the chief justice before the hearing is restarted.

Senior counsel S S Nariman appearing for Cogentrix pleaded for an early hearing as the stay granted earlier by the court was serving no purpose and due to it counter-guarantee could not be obtained.

The counsel said the entire project had been stalled due to the public interest litigation in which Karnataka high court ordered an inquiry by the Central Bureau of Investigation into allegations of heavy bribes having been paid to certain political entities.

It was against this order that Cogentrix, the state of Karnataka and others have come before the Supreme Court by way of appeal.
